Terms of Service

These Terms of Service ("Terms") govern access to and use of the AvioMentor platform, websites, and services (collectively, the "Service"), operated by AVIO MENTOR SL (NIF: B26665257), with registered address at Av. Maisonnave, 41, n° 3, 03003 Alicante (Alacant), Alicante, Spain ("AvioMentor", "we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Nature of the Service
AvioMentor is an educational technology (EdTech) SaaS platform that provides study and training tools for aviation theory.
The Service:
- is provided solely as a study and training aid
- is not official exam material
- does not reproduce or represent official examination questions
- does not guarantee exam success
- is not affiliated with EASA, AESA, SENASA, or any aviation authority
Users remain fully responsible for their own training, exam preparation, and compliance with applicable aviation regulations.
2. Eligibility and Accounts
2.1 Eligibility
The Service is available to users who are at least 16 years old.
By creating an account, you confirm that you meet this requirement.
2.2 Account Registration
Access to the Service requires creating an account. You are responsible for:
- maintaining the confidentiality of your login credentials
- all activity performed under your account
2.3 Account Sharing and Fraud
Accounts are personal and non-transferable.
The following are strictly prohibited:
- account sharing
- credential distribution
- concurrent use by multiple users
- resale or sublicensing of access
Any such activity is considered fraud and may result in immediate suspension or termination without notice.
3. Subscriptions and Payments
3.1 Subscription Types
B2C (Individual Users)
AvioMentor offers time-based subscriptions, including:
- 1 month
- 3 months
- 6 months
Subscriptions provide immediate access to digital content.
B2B (Flight Schools, DTOs, ATOs)
Business customers are billed based on:
- number of active students per month, multiplied by an agreed unit price
- optional monthly or annual administrative platform fees
3.2 Billing and Auto-Renewal
All subscriptions renew automatically unless cancelled before the end of the current billing period.
Payments are processed exclusively through Stripe. AvioMentor does not store or process payment card details.
3.3 VAT and Taxes
B2C: Prices include VAT. Until applicable thresholds are reached, Spanish VAT (21%) applies. Thereafter, VAT may be applied according to EU OSS rules, handled automatically via Stripe.
B2B (EU): Invoices are issued net of VAT, where applicable, in accordance with EU VAT reverse-charge rules.
3.4 Price Changes
AvioMentor reserves the right to modify pricing at any time. Users will be notified of material price changes in advance. Updated prices apply on renewal.
4. No Right of Withdrawal / Refund Policy
Due to the nature of the Service as digital content with immediate access, the statutory 14-day right of withdrawal is excluded in accordance with EU consumer law.
Accordingly:
- No refunds are issued for subscriptions once purchased or renewed
- This applies equally to automatic renewals
- Users must cancel their subscription before the renewal date to avoid charges
- Cancellation takes effect at the end of the current billing period.
5. Acceptable Use
Users must not:
- copy, download, scrape, or extract content
- share or redistribute content outside the platform
- reverse engineer or attempt to access source data
- use automated tools or bots
- use the Service to build or support competing products
- submit or attempt to submit real examination questions
- misuse the Service in violation of law or third-party rights
Any attempt to submit real exam questions is illegal and may be reported to the relevant authority.
6. Intellectual Property
All content provided through the Service, including questions, explanations, structure, design, software, and databases, is owned exclusively by AvioMentor and protected by intellectual property laws.
Users receive a limited, non-exclusive, non-transferable license to access and use the Service only within the platform.
Any other use is strictly prohibited.
7. Suspension and Termination
AvioMentor may suspend or terminate access immediately, without notice, if:
- payment fails or is reversed
- fraud or account sharing is detected
- a serious legal or contractual breach occurs
- required by law or authority
For non-payment, Stripe's standard retry and collection mechanisms apply. If payment ultimately fails, access is revoked.
8. Limitation of Liability
The Service is provided "as is" and "as available".
To the fullest extent permitted by law:
- AvioMentor assumes no liability for exam outcomes, training decisions, or professional consequences
- AvioMentor is not responsible for errors, omissions, interruptions, or content accuracy
- AvioMentor is not liable for indirect, incidental, or consequential damages
- Total liability, if any, is strictly limited to the fees paid by the user during the preceding 12 months.
9. Changes to the Service
AvioMentor may modify, improve, or discontinue parts of the Service at any time.
We commit to maintaining the core functionality of paid features, but the format, structure, or implementation may evolve.
10. Governing Law and Jurisdiction
These Terms are governed by Spanish law.
Any disputes shall be submitted to the courts and tribunals of Spain, without prejudice to mandatory consumer protection rules.
11. Language
The primary language of the Service is English.
Local language versions may be provided where licenses are offered.
In case of conflict, the English version prevails.
